Intestacy and Partial Intestacy (No Will)

Intestacy Laws

Intestacy is when there is no valid Will. In that case if you are not included in the State legislation as a beneficiary you may contest the lack of provision or seek further provision just as you would if there was a valid Will. Your claim would follow the normal process as if there was a will. The court would consider all competing claims on the estate.

Each State has a different list of beneficiaries when there is no Will. Please see the list under “Intestacy” for each State to be found on this site.
